Terms of Service & Sales

1. Off-road / motorsport use only

The MANA ECU is sold as a competition and off-highway product. It is intended for vehicles used exclusively in off-road, closed-course, and motorsport settings.

• MANA ECU makes no emissions-compliance claims of any kind. It is not CARB-certified and not EPA-certified, and it has no CARB Executive Order number.
• Installing it on a vehicle that is registered, insured, or driven on public roads may be illegal where you live. You — the buyer — are solely responsible for knowing and complying with the federal, state, provincial, and local laws that apply to your vehicle.
• By purchasing, you confirm the product will be used only in applications where its use is lawful.

2. Reservations, payment & refunds

Founding-batch units are sold by reservation. Your reservation locks your price and your numbered place in the build queue, in the order reservations are received.

• Paid in full at checkout. You pay the listed price of your unit, plus shipping and any sales tax (section 3), when you check out. Payment is processed by Square.
• 72-hour hold. If you reserve without paying, your spot is held for 72 hours. If payment isn't received within that window, the spot is released to the next person in line.
• Refunds before shipment. Reservation payments are fully refundable on request at any time before your unit ships. Email us and we'll process it — no forms, no arguing.
• After shipment. Once your unit has shipped, payments are non-refundable. From that point forward the limited warranty below covers you instead.

3. Shipping & sales tax

• US orders ship by USPS Priority Mail Flat Rate. The shipping charge is shown before you pay and added to your order.
• Alabama sales tax is added only when your order ships to an Alabama address. Shipping itself is not taxed.
• Outside the US, we quote shipping by email after you order, before anything ships.

4. Limited warranty

Every MANA ECU and MUT Reader is covered by a 12-month limited warranty against defects in materials and workmanship, starting the day your unit ships.

• What we do: if your unit has a manufacturing defect, we will repair or replace it, at our discretion, at no charge.
• What voids it: physical abuse or impact damage, water ingress past the enclosure seals, overvoltage or reversed polarity, and opening, modifying, or otherwise tampering with the board or enclosure.
• The warranty covers the ECU or reader itself. It does not cover damage to your engine, harness, or vehicle, consumables (sensors, fuses), or labor to remove and reinstall the unit.
• Warranty shipping: email us before sending anything. You pay to ship the unit to us. If the claim is covered, we pay to ship the repaired or replacement unit back to you.
• This warranty is the exclusive remedy and replaces all other warranties, express or implied, including merchantability and fitness for a particular purpose, to the extent allowed by law.

5. Limitation of liability

This product controls an engine. Correct installation, configuration, and tuning are the responsibility of the installer and operator. An engine management fault — from installation error, mis-tuning, wiring problems, or component failure — can damage an engine or cause a vehicle to behave unexpectedly.

• You accept that you install and operate the MANA ECU at your own risk.
• To the maximum extent permitted by law, NextGear's total liability arising from any product is capped at the purchase price you paid for that product.
• We are not liable for consequential, incidental, or indirect damages — including engine or vehicle damage, towing, lost use, or lost income — even if advised of the possibility.
• Some jurisdictions don't allow certain limitations; where that's the case, these limits apply to the fullest extent permitted.

6. Privacy & confidentiality

Your information stays confidential. We collect only what we need to build, ship and support your unit, and we do not disclose it.

• What we keep confidential: your name, email, phone, shipping address, vehicle details, order and payment history, your unit's serial number, and any tune files, datalogs or diagnostic data you send us.
• We do not disclose it to other customers, other businesses, partners, advertisers, or anyone else. We never publish your name, your car or your build number without your written permission.
• The only exceptions: the service providers that process your order for us, given only what their job needs (Square for payment, the shipping carrier for delivery, and our website and email providers); disclosure required by law, such as a court order or subpoena; or anything you ask us in writing to share.
• Outside help, only with your OK. Sometimes the fastest fix for your car is a second opinion from an outside specialist we trust. We ask you first, and share only the details that problem needs, and only after you say yes. They use it only to help with your unit.
• Card details never reach us. Square handles your card; we see the payment result, not the card number.
• Interest-list signups receive project updates about MANA. You can unsubscribe any time by replying to any email and saying so.
• We never sell your data. Not to advertisers, not to "partners," not to anyone.
• To see, correct or delete the information we hold about you, email us. We keep only what we need for warranty, tax and legal records.

7. Governing law

These terms are governed by the laws of the State of Alabama, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Alabama.
